1. Introduction
Welcome to FromLead, a service provided by Ash + Lake Inc. (“we”, “us”, or “our”). By using our services, including FromLead and our marketing services, you agree to comply with and be bound by the following Terms of Service (“TOS”). Please read these TOS carefully.
2. Services Provided
- FromLead: Our FromLead service offers a comprehensive suite of marketing tools, including CRM, email marketing, and automation.
- Marketing Services: We provide a range of marketing services, including ad management, content creation, web design, lead generation, and cold outreach.
3. User Accounts
- Account Creation: To use our services, you must create an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated.
- Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Use of Services
- Acceptable Use: You agree to use our services only for lawful purposes and in accordance with these TOS. You agree not to use our services:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of our services, or which, as determined by us, may harm us or users of our services or expose them to liability.
- To impersonate or attempt to impersonate Ash + Lake Inc., an Ash + Lake Inc. employee, another user, or any other person or entity.
5. Fees and Payment
- Fees: You agree to pay all fees associated with your use of our services. All fees are non-refundable unless otherwise stated in our Refund Policy.
- Payment: Payment for services is due in advance. You authorize us to charge your payment method on a recurring basis, in accordance with the terms of your subscription plan. By providing a payment method, you represent and warrant that you are authorized to use the payment method and that you authorize us to charge your payment method for the total amount of your subscription (including any applicable taxes and other charges).
- Automatic Billing: All fees are billed automatically by Ash + Lake Inc. on a recurring basis according to your subscription plan. You will receive a receipt by email once your payment has been processed.
- Late Payments: If your payment method fails or your account is past due, we reserve the right to suspend or terminate your access to the services. You agree to promptly update your payment information to ensure timely payments.
6. Refund Policy
- 30-Day Money-Back Guarantee: We offer a 30-day money-back guarantee for FromLead. If you are not satisfied with our service, you may request a full refund within 30 days of your initial purchase.
- Prorated Refunds: After the initial 30 days, if you wish to cancel your subscription, you will be eligible for a prorated refund for the balance of the month in which you cancel. The prorated amount will be calculated based on the number of days remaining in your current billing cycle.
- Marketing Services Refunds: Due to the nature of marketing services, we do not offer refunds once work has commenced. If you have concerns about our services, please contact us to discuss potential resolutions.
7. Intellectual Property
- Ownership: All content, features, and functionality included in our services, including but not limited to text, graphics, logos, and software, are the property of Ash + Lake Inc. and are protected by intellectual property laws.
- License: We grant you a limited, non-exclusive, non-transferable license to access and use our services for your personal or business use, subject to these TOS.
8. Termination
- By You: You may terminate your account at any time by contacting us at privacy@connect.ashandlake.com. Termination will take effect at the end of your current billing cycle.
- By Us: We reserve the right to terminate or suspend your account and access to our services, without prior notice or liability, for any reason, including but not limited to breach of these TOS.
9. Limitation of Liability
To the fullest extent permitted by law, Ash + Lake Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
10. Governing Law
These TOS and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law principles.
11. Changes to Terms of Service
We may update these TOS from time to time. We will notify you of any changes by posting the new TOS on our website. You are advised to review these TOS periodically for any changes. Your continued use of our services after any changes constitutes your acceptance of the new TOS.
